सत्येंद्र जैन को निलंबित करने की मांग वाली याचिका पर दिल्ली हाईकोर्ट ने कहा- सीएम विचार करेंगे (लीड-1)

नई दिल्ली, 27 जुलाई (आईएएनएस)। दिल्ली हाईकोर्ट ने राष्ट्रीय राजधानी के गिरफ्तार मंत्री सत्येंद्र जैन को कैबिनेट पद से निलंबित करने की मांग वाली याचिका को खारिज करते हुए बुधवार को कहा कि इस बारे में अदालत नहीं, बल्कि मुख्यमंत्री तय करेंगे।

हाईकोर्ट ने कहा कि इस बारे में राज्य के सर्वोत्तम हित में मुख्यमंत्री ही विचार करेंगे कि क्या आपराधिक पृष्ठभूमि वाले व्यक्ति को मंत्री के रूप में बने रहने की अनुमति दी जानी चाहिए या नहीं।

मुख्य न्यायाधीश सतीश चंद्र शर्मा और न्यायमूर्ति सुब्रमण्यम प्रसाद की खंडपीठ याचिकाकर्ता पूर्व भाजपा विधायक नंद किशोर गर्ग की याचिका पर सुनवाई कर रही थी, जिन्होंने दलील देते हुए कहा है कि जैन एक लोक सेवक हैं, जिन्होंने जनता के हित में कानून के शासन को बनाए रखने की संवैधानिक शपथ ली है और उन्हें हवाला लेनदेन में उनकी कथित भूमिका के आरोप में गिरफ्तार किया गया है।

पीठ ने आदेश में कहा, मुख्यमंत्री मंत्रिमंडल के सदस्यों को चुनने और मंत्रिपरिषद की नियुक्ति से संबंधित नीति तैयार करने में अपने विवेक का प्रयोग करते हैं। भारत के संविधान की अखंडता को बनाए रखने के लिए मंत्रिपरिषद की सामूहिक जिम्मेदारी है। यह मुख्यमंत्री के लिए राज्य के सर्वोत्तम हित में कार्य करना है और यह विचार करना है कि क्या कोई व्यक्ति जिसकी आपराधिक पृष्ठभूमि है और/या उसके खिलाफ नैतिक अधमता से जुड़े अपराधों के आरोप लगाए गए हैं, उन्हें नियुक्त किया जाना चाहिए और उन्हें मंत्री के रूप में बने रहने की अनुमति दी जानी चाहिए या नहीं।

हाईकोर्ट ने कहा कि कोर्ट का काम मुख्यमंत्री को निर्देश देना नहीं है, लेकिन यह कर्तव्य है कि अहम पदों पर बैठे लोगों को हमारे संविधान के सिद्धांतों को कायम रखने में उनकी भूमिका की याद दिलाई जाए।

अदालत ने कहा, न्यायालय अच्छे या बुरे के फैसले को लेकर नहीं है, मगर यह निश्चित रूप से संवैधानिक पदाधिकारियों को हमारे संविधान के लोकाचार को बनाए रखने, संरक्षित करने और बढ़ावा देने के लिए याद दिला सकता है। एक उपधारणा है कि मुख्यमंत्री को ऐसे संवैधानिक सिद्धांतों द्वारा अच्छी तरह से सलाह और मार्गदर्शन दिया जाएगा।

अदालत ने भारतीय संविधान के पिता माने जाने वाले डॉ. बी. आर. अंबेडकर की ओर से की गई टिप्पणी का भी जिक्र किया जिन्होंने संविधान सभा की बहस के दौरान कहा था कि भले ही एक संविधान अच्छा हो, मगर यह निश्चित रूप से तब खराब हो जाता है, जब इसे चलाने वाले गलत लोग होते हैं। इसके अलावा संविधान कितना भी बुरा हो, मगर यह तब अच्छा हो सकता है, यदि इसे चलाने वाले बहुत अच्छे हों। संविधान का काम पूरी तरह से संविधान की प्रकृति पर निर्भर नहीं करता है।

आदेश में कहा गया है, यह अदालत बी. आर. अंबेडकर की टिप्पणियों से पूरी तरह सहमत है और यह उम्मीद करती है कि मुख्यमंत्री लोगों का नेतृत्व करने के लिए व्यक्तियों की नियुक्ति करते समय अपने में रखे गए उस भरोसे को कायम रखेंगे, जो एक प्रतिनिधि लोकतंत्र की नींव बनाता है।
